Terms & Conditions

These Terms & Conditions (the “Terms”) govern your access to and use of KlikSend (“KlikSend”, the “Service”), a secure file-transfer portal operated by Municipex (Pty) Ltd trading as NanoCrew (“NanoCrew”, “we”, “us” or “our”). KlikSend lets you upload files and share them with others through secure, optionally password-protected, expiring links. By creating a KlikSend login account or otherwise using the Service, you agree to these Terms. They are intended to align with the Protection of Personal Information Act, 2013 (POPIA) and, where relevant, the Promotion of Access to Information Act, 2000 (PAIA).

This document is a professional template. It is not legal advice. The operator should have it reviewed and adapted by qualified legal counsel before relying on it, and should ensure the practices described here accurately reflect how the Service actually operates.

1 / Acceptance of these Terms

By registering for, accessing or using KlikSend, you confirm that you have read, understood and agree to be bound by these Terms and by any policies referenced in them, including our Privacy Policy. If you are using KlikSend on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms. If you do not agree, you must not use the Service.

2 / The KlikSend service

KlikSend does one thing: it allows authorised users to upload files and generate secure links so that those files can be downloaded by intended recipients. Each share link is unguessable, and may be protected with a password and configured to expire after a set period. KlikSend is a file-transfer tool only; it does not provide any other product, feature or form of data beyond the files you yourself choose to upload and share.

KlikSend is part of the NanoCrew family of tools — “Three tools. One crew.” — and pairs with NanoCrew Sync. Your use of any separate NanoCrew tool is governed by the terms applicable to that tool.

3 / Your account and responsibilities

To upload and share files you must hold a KlikSend login account. You are responsible for providing accurate registration details, for keeping your credentials confidential, and for all activity that occurs under your account. You must notify us promptly at info@nanocrew.ai if you suspect any unauthorised use of your account. We may require verification of your email address and may suspend access where we reasonably believe your account has been compromised.

4 / Acceptable use and prohibited content

You may use KlikSend only for lawful file transfer and only for files you are entitled to share. You agree not to upload, store or distribute through the Service any file that:

  • is unlawful, defamatory, harassing or otherwise objectionable;
  • infringes the intellectual property, privacy or other rights of any person;
  • contains malware, viruses, ransomware or any other malicious or harmful code, or is designed to disrupt, damage or gain unauthorised access to any system;
  • contains personal information that you are not lawfully entitled to process or share under POPIA;
  • is intended to circumvent the security, password protection or expiry controls of the Service, or to overload or interfere with its infrastructure.

You are solely responsible for the content of the files you upload and for ensuring you have the right to share them with your chosen recipients. We may remove files or suspend links that we reasonably believe breach these Terms or applicable law.

5 / Share links, passwords and expiry

Share links generated by KlikSend are unguessable by design. You may additionally protect a link with a password and set it to expire after a chosen time or download limit. These controls are tools to help you share securely; their effectiveness depends on how you use them. You are responsible for choosing strong passwords, for distributing links and any passwords only to intended recipients through appropriate channels, and for setting expiry terms suitable to the sensitivity of the files. We do not control what recipients do with files once downloaded.

6 / Availability and service levels

We aim to keep KlikSend available and reliable, but the Service is provided on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted, error-free or free from delay, and we may carry out maintenance, updates or changes that temporarily affect availability. Unless a separate written service-level agreement is in place, no specific uptime or response time is guaranteed.

7 / Limitation of liability

To the maximum extent permitted by law, NanoCrew will not be liable for any indirect, incidental, special or consequential loss, or for loss of data, profits, revenue, goodwill or business, arising out of or in connection with your use of, or inability to use, the Service. Nothing in these Terms excludes or limits any liability that may not lawfully be excluded or limited under South African law, including under the Consumer Protection Act, 2008 where it applies. You remain responsible for keeping your own backup copies of any files you upload.

8 / Intellectual property

KlikSend, the NanoCrew name and branding, and all software, design and materials comprising the Service are owned by or licensed to Municipex (Pty) Ltd t/a NanoCrew and are protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You retain all rights in the files you upload; you grant us only the limited rights necessary to store, transmit and make those files available via the share links you create.

9 / Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. You agree to submit to the jurisdiction of the South African courts in respect of any dispute arising out of or in connection with these Terms or the Service. KlikSend is SA-built and POPIA-aligned, with coverage across South Africa, Africa and internationally.

10 / Suspension and termination

You may stop using the Service and close your login account at any time. We may suspend or terminate your access, with or without notice, where you breach these Terms, where required by law, or to protect the security or integrity of the Service. On termination, your right to use the Service ends and active share links may cease to function. Provisions that by their nature should survive termination — including those on acceptable use, intellectual property, limitation of liability and governing law — will continue to apply.

11 / Changes and contact

We may update these Terms from time to time. Where changes are material we will take reasonable steps to notify users, and continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
